
TERMS & CONDITIONS
1. Introduction These Terms and Conditions outline the agreement between Daäna Design ("Designer") and the Client ("Client") for graphic design services. By engaging the Designer's services, the Client agrees to these terms.
2. Services Provided The Designer agrees to provide graphic design services as per the scope outlined in the project proposal or agreement. Services may include but are not limited to Digital Artwork, Branding, Product Packaging, 3D Modelling, Logo Design, Motion Graphics, Animation.
3. Payment Terms

A 50% non-refundable deposit is required before work commences.

The remaining 50% balance is due upon project completion before final files are delivered.

Payments are to be made via PayPal, Wise, Email Money Transfer, or Direct Bank Deposit.

Late payments may incur a 5% late fee per week.
4. Revisions and Approvals

The Client is entitled to 2 rounds of revisions as specified in the project agreement.

Additional revisions beyond the agreed number will will incur additional charges based on the estimated time required for the modifications.

Any requested revisions that fall outside the original design concept as initially communicated by the Client will be considered a change in scope and will incur additional charges based on the estimated time required for the modifications.

Any additional requests that were not included in the original project scope will be subject to additional fees, determined based on the complexity and time required to fulfill the request.

If the Client does not provide a specific design concept and chooses to leave creative direction entirely to the Designer, it is understood that the Client trusts the Designer's artistic vision. In such cases, any requested revisions that significantly deviate from the delivered design will be treated as a change in scope and will incur additional charges based on the estimated time required for the modifications.

Final approval must be provided in writing before the delivery of final files.
5. Turnaround Time and Delays

Estimated turnaround times will be outlined in the project proposal.

Delays due to lack of Client response, incomplete information, or changes to the original brief may result in an adjusted timeline and additional costs.
6. Ownership and Copyright

Upon full payment, the Client will receive the rights to use the final design for the agreed purpose.

The Designer retains the right to showcase the work in their portfolio unless otherwise agreed in writing.

Raw design files (such as AI, PSD, or editable files) remain the property of the Designer unless a buyout is negotiated.
7. Cancellation and Refunds

If the Client cancels the project after the deposit is paid, no refund will be issued.

If the Designer cancels the project, a pro-rated refund will be provided based on work completed.
8. Liability and Indemnification

The Designer is not responsible for any legal claims related to trademark or copyright infringement.

The Client agrees to indemnify and hold the Designer harmless against any claims related to the use of the designs.
9. Confidentiality Both parties agree to keep confidential any proprietary information shared during the project.
10. Governing Law These Terms and Conditions shall be governed by the laws of the Canadian Government. Any disputes shall be resolved through mediation before legal action is taken.
